1. What Gruppeo is
Gruppeo (gruppeo.com) is a free, non-commercial service where cyclists and runners publish joint training sessions and rides (“meetups”) and sign up for them. The service is run by Tomasz Błażusiak, Kamperstr. 29, 40589 Düsseldorf, Germany (the “operator”), contact: kontakt@gruppeo.com or the contact form. This address is also the point of contact for users and authorities within the meaning of Art. 11 and 12 DSA.
2. Account
- Only people aged 18 or over may create an account.
- You log in with your email address and password, or with a link we send to your email address. Keep your password and your mailbox secure.
- Your nickname must not impersonate other people, contain other people’s personal data or be offensive.
- The same rules apply to the profile description as to meetups and comments (section 3). Logged-in users can report a profile, and moderation can remove the description.
- You can delete your account at any time in the account window. Deletion is permanent.
3. Rules for meetups
- A meetup must be a genuine group bike ride or running session, open to other participants.
- Commercial meetups (paid tours, advertising for services or shops) and races on public roads are prohibited.
- Unlawful, offensive, discriminatory and misleading content and spam are prohibited.
- The route, pace and level must be described accurately, so that participants can judge whether they can keep up.
- Cancel a meetup on the service if it is not going to take place.
- By uploading a route (e.g. a GPX file), you declare that you are entitled to share it, that you are not infringing the rights of others and that the route does not pass through areas where entry is prohibited.
- By publishing content, you grant the operator a non-exclusive, free-of-charge right to display it on the service for as long as it is published. You retain the rights to your content.
3a. Comments
- Comments are for discussing a specific meetup: questions, arrangements, thanks after the ride.
- The rules in section 3 apply to comments: unlawful, offensive and discriminatory content, advertising and spam are prohibited. Do not publish other people’s personal data (e.g. phone numbers).
- The organiser can delete comments on their meetup. Everyone can delete their own comments.
3b. Groups and group chat
- Any adult with an account can create a group and becomes its admin. A public group is visible in the list of groups, and anyone can join it. A private group can only be joined via the invitation link shared by its admins.
- Admins are responsible for their group: they can change its description, remove messages and members, give admin rights to other members and delete the group. If the last admin leaves the group, the longest-standing member becomes admin.
- The rules in section 3 apply to the group name and description and to chat messages. The chat is for arranging training sessions together and talking about them. Prohibited content includes, among other things, unlawful content, harassment, advertising and spam.
- Any member can report a message, and any logged-in user can report a group (section 5). The operator does not review chats on its own initiative, but does check reported content.
- A group can have up to 500 members; one person can create up to 10 groups and belong to up to 50 groups.
4. Taking part in meetups
- Gruppeo is solely a noticeboard. The operator does not organise meetups, does not check routes, their condition or safety, does not verify participants and is not a party to any arrangements between them.
- The organiser of a meetup is a user like everyone else, not a guide or a professional tour operator, and does not act on behalf of Gruppeo or the operator.
- Taking part is voluntary and at your own risk. For damage occurring during a meetup, for example as a result of collisions, falls, the condition of the surface or the technical condition of the bike, the participants are liable under the general statutory rules, not the operator of the service. We recommend having personal liability insurance and accident insurance.
- All participants must follow the traffic rules of the country in which the meetup takes place, including the rules for riding or running in a group, and are responsible for their own equipment, e.g. for a roadworthy bike. We recommend that cyclists wear a helmet and that runners wear reflective gear after dark.
5. Reports and moderation
- Anyone, even without an account, can report a meetup using the “Report this meetup” button. Logged-in users can report comments, profiles, groups and group chat messages using “Report”. The report should explain why the content breaks the law or these terms of use (Art. 16 DSA).
- Reports are reviewed manually by the operator, without automated systems. The operator may hide content that breaks the law or these terms and, in the event of serious or repeated violations, block the account.
- If a meetup, comment, group or message is hidden, its author is informed on the service, together with the reasons for the decision (Art. 17 DSA). The decision can be appealed via the contact form. The operator will review the appeal and reply by email.
- If content indicates a threat to the life or safety of persons, the operator informs the competent authorities (Art. 18 DSA).
6. Liability
The service is free of charge and provided on a best-effort basis, with no guarantee of constant availability. The operator is liable without limitation for damage resulting from injury to life, body or health, for damage caused intentionally or through gross negligence, and in all other cases in which liability cannot be limited by law. Otherwise, the operator’s liability is excluded. The authors of content published by users are responsible for that content.
7. Changes and applicable law
- We will inform you of changes to these terms on the service in advance. The first time you log in after a change, we will ask you to accept the new version. If you do not accept it, you can delete your account.
- German law applies. If you are a consumer, you retain the protection afforded to you by the mandatory provisions of the law of the country in which you are habitually resident.
